Gerald Zingone is a senior counsel in Pillsbury’s Litigation practice and is located in the Washington, DC, office, where he focuses on complex commercial litigation.
Gerald has represented clients in state and federal courts throughout the United States and in arbitration proceedings domestically and abroad. He represents clients in industries including pharmaceuticals and biological products manufacturing, heavy machinery manufacturing, and commodity sellers and traders. He has substantial experience defending clients in antitrust, product liability and class action lawsuits, and is particularly experienced in addressing the needs and concerns of foreign clients engaged in disputes in the United States (court proceedings, arbitration and mediation) and in international arbitrations.
Representative Experience
- Represented Kone Corporation in the elevator defendants’ successful defeat of price-fixing allegations at the motion to dismiss stage (In re Elevator Antitrust Litigation).
- Represented Potash Corporation of Saskatchewan in the fertilizer defendants’ successful defeat of price-fixing allegations at the summary judgment stage (Blomkest Fertilizer v. Potash Corporation of Saskatchewan, Inc. et al ).
- Established the right of a vaccine manufacturer to the immunity afforded by the government contractor defense at the summary judgment stage (Ammend et al v. BioPort, Inc. et al).

- Successfully obtained dismissal of product liability claims against a foreign manufacturer based upon lack of personal jurisdiction (Holland America Line, Inc. v. Wartsila North America, Inc. et al).
- Represented a nonprofit advocacy group in the defeat of claims that it engaged in a conspiracy to fraudulently increase sales of a pharmaceutical product (Vess v. Ciba Geigy Corp. et al).
- Trial verdict obtained in favor of a commodity trader on breach of contract claim affirmed on appeal. (PCS Sales (USA) Inc. v. Nitrochem Distrib. Ltd.).
- Successfully obtained dismissal of securities fraud, conspiracy and RICO claims on behalf of a Canadian securities brokerage firm at the summary judgment stage (Francis R. Bean v. Cambridge Investments, et. al).
