During the COVID-19 pandemic, working remotely became the rule rather than the exception. When the nationwide lockdown was lifted, many believed that employees—in this case, lawyers—would return to their offices. Because law firms’ corporate and government legal departments are still struggling to convince personnel to come into the office regularly, the ethics of working remotely continues to be an issue that lawyers must face.
In his article “The Ethics of Working From Home,” Litigation partner David Keyko discusses ethics opinions and rules addressing working remotely; in-house counsel concerns regarding lawyers practicing in a state without being admitted to that state’s bar; choice of law issues including the consideration of Rules of Professional Conduct and the ABA’s Model Rule 8.5; along with other ethical considerations.
