In his presentation, Rob James discussed the impact that the fine print in procurement and transportation contracts can have on risks, costs, obligations and liabilities of the shippers, customers and carriers in the global logistics chain. Examples included the ill-fated voyages of the good ships ONE APUS and the EVER GIVEN. As Rob remarked, “three-letter acronyms can pack an unexpected wallop.”

New to the context are environmental, social and governance (ESG) clauses, which mandate disclosure, measurement and reduction of carbon emissions and the use of renewable fuels. Several of these clauses are now being used in bills of lading and purchase orders worldwide.
