Pillsbury partner Jeewon Serrato will participate in a panel discussion titled, “All About the New Rules to Prevent Access to Americans’ Sensitive Personal Data.” The discussion will focus on the DOJ’s “Data Security Program,” which was recently finalized in coordination with the Cybersecurity and Infrastructure Security Agency. This new framework is intended to address an “unusual and extraordinary threat to the national security and foreign policy of the United States posed by the continuing effort of certain countries of concern to access Americans’ sensitive personal data and U.S. government-related data.” The panel will merge policy and practice, examining the new framework for prohibiting and restricting certain commercial transactions involving access to designated data types by countries such as China and Russia. After exploring the background and rationale behind the new program, the panel will dive into practical compliance tips and common pitfalls, merging the perspectives of privacy and national security law.

What you will learn:

  • The underlying rationale for the executive order and draft regulations, as well as the core features of the regulations.
  • Answers to frequently asked questions from private sector stakeholders in various industry sectors, outside counsel and the public interest community, including impact on different sectors, relationship to U.S. international obligations, interaction with the U.S.-EU Data Privacy Framework, and interoperability with GDPR and other privacy frameworks.
  • How companies and institutions can bring themselves into compliance with, and avoid civil and criminal penalties under, this new cross-border data security framework.
