In a recent Q&A with Greater China Business, Litigation counsel Michelle Ng discussed the challenges Chinese enterprises face in cross-border disputes, how to best minimize risk and her litigation team’s impressive track record.
Acknowledging the many differences between litigation in the U.S. and China, Ng said “the most obvious difference is in discovery.” The discovery process “can be very challenging for parties, especially non-U.S. parties, who are not accustomed to extensive discovery in U.S. litigation.”
Additionally, when considering how Chinese companies can best minimize risk when seeking to expand internationally, Ng said: “It’s important to have a mature compliance structure in place.”
“For companies looking to expand overseas, it’s important to familiarize yourself with the local rules that apply to their business, which can help them avoid inadvertently violating local regulations and authorities,” she added.
