In a recent analysis of the biggest patent decisions of 2024, Law360 interviewed Intellectual Property partner David Tsai, who addressed the Telefonaktiebolaget LM Ericsson v. Lenovo (United States) Inc. case. This case, which saw the U.S. Court of Appeals for the Federal Circuit grant Lenovo the chance to block Ericsson from enforcing South American injunctions, centers on a dispute over patents critical to the 5G standard.

While the decision may now make similar anti-suit injunction rulings easier to win, Tsai said, “this is important because it really tells the world that the U.S. is...trying to bring it back to the U.S., in terms of having some of these SEP issues decided here versus in foreign forums.”
