In an extensive one-on-one interview with Law360, Government Law & Strategies partner Brian Finch described the provisions and protections provided by the Support Anti-Terrorism by Fostering Effective Technologies or SAFETY Act.
Through the federal SAFETY Act, which was enacted following the September 11 terrorist attacks, commercial property owners can protect themselves from costly lawsuits by applying and obtaining liability protections for their security programs. Among other upsides, this can significantly lower insurance costs, according to Finch.
When asked who would most benefit from SAFETY Act protections, Finch said, “High-profile or trophy real estate properties, iconic real estate buildings or locations that have implemented what they consider to be a fairly rigorous security program, I would think they would definitely want to do that. Just by the mere fact that they are investing in security, and including within that anti-terrorism services, they've acknowledged that there's a risk. Why not take the next step and pursue protections that they could use in court?”
